On March 24, a New Mexico jury found Meta liable for violating the state’s consumer protection laws by concealing what it knew about child sexual exploitation on Facebook and Instagram, ordering the company to pay $375 million in civil penalties. The following day, a Los Angeles jury found Meta and YouTube negligent for designing platforms that harmed a young woman who became addicted to social media as a child, awarding $3 million in compensatory damages and $3 million in punitive damages. 

These verdicts mark the first time juries have held major tech companies financially accountable for the harms their platforms inflict on children. Together, they establish that platforms like Roblox which prioritize engagement and profits over child safety can and will be held liable. As juries across the country send a clear message that accountability has arrived for Big Tech, the case against Roblox only grows stronger. 

Along with her co-lead counsel in the In Re: Roblox Corporation Child Sexual Exploitation and Assault Litigation, Girard Sharp’s Sarah London released the following statement:

“These back-to-back verdicts are only the beginning for platform accountability. For too long, Big Tech companies like Meta and Roblox have intentionally designed their platforms to prioritize growth and engagement over the safety of their youngest users. GIRARD SHARP SECURES FINAL APPROVAL OF $195 MILLION XYREM ANTITRUST SETTLEMENT  

Settlement resolves litigation against Jazz Pharmaceuticals, Hikma Pharmaceuticals 

SAN FRANCISCO, CA – Girard Sharp LLP, a national leader in class action and antitrust litigation, is pleased to announce that the United States District Court for the Northern District of California has granted final approval for two settlements resolving the Xyrem antitrust litigation. The settlements, totaling $195 million, resolve claims against Jazz Pharmaceuticals and Hikma Pharmaceuticals for their alleged anticompetitive conduct related to the sale of Xyrem, a drug used to treat narcolepsy. 

In granting final approval, the Court recognized the significance of the settlements, which provide substantial relief to union health plans, businesses, and other entities that paid for Xyrem prescriptions, noting that the $195 million recovery represents a 46% recovery on the estimated damages. This recovery is among the largest in recent years for end-payor class actions involving generic drug delays. 

“An excellent job was done in this case,” said The Honorable Richard Seeborg, Chief Judge of the United States District Court for the Northern District of California, in his order. “And I congratulate you and congratulate the defense side on reaching your resolution and litigating it very effectively.” 

“These settlements bring closure to a complex, multi-year battle and provide much-needed financial relief to the impacted class members,” said Dena Sharp, Managing Partner at Girard Sharp. “This case underscores our commitment to holding pharmaceutical companies accountable for practices that delay competition and keep prices for prescription drugs higher than they should be.”  

The case, filed in 2020, focused on the defendants’ alleged efforts to delay the entry of a generic version of Xyrem, thereby maintaining supracompetitive prices shouldered by the class of payers for these important prescription drugs. Dena spoke to the growing concern around AI-generated fraudulent claims in class action settlements, highlighting a notable example from the $45.5 million Juul-Altria settlement in which over 14 million claims were submitted, many of them fraudulent and potentially driven by bots. 

“This is the give-and-take of us using all the capabilities of the internet and digital technology to drive claims and to really try to make sure that we get money into class members’ hands,” Dena told Law360. “At the same time, we’re dealing with a flood of fraudulent claims that are driven to some degree by all of these technological capabilities that are out there.”
