Trevor Tan Recognized as a “Rising Star” by Law360

Girard Sharp is pleased to announce that associate Trevor Tan has been recognized as part of the 2024 “Rising Star” lawyer by Law360. Trevor secured a $54 million settlement for Ponzi scheme victims, earning him a well-deserved spot among Law360’s Rising Stars under 40 in class action law.

Trevor Tan led a pivotal motion against a national bank, resulting in a $54.2 million settlement for victims of a Ponzi scheme run by Woodbridge Investments and its founder. His strategic “common sense” argument highlighted the bank’s likely knowledge of the fraud, overcoming significant legal obstacles. This achievement brought financial relief to many retirees affected by the scheme, marking a proud milestone in Tan’s career.

Girard Sharp Appointed Co-Lead Counsel in Tires Antitrust Litigation

Last week, Girard Sharp, along with co-counsel at Lowey Dannenberg P.C., Korein Tillery P.C., and Robins Kaplan LLP, was appointed interim lead counsel in litigation arising from unlawful agreements between some of the largest tire companies, including Goodyear, Michelin, and Bridgestone, to artificially increase tire prices for millions of Americans. Girard Sharp and their cocounsel represent consumers who purchased new replacement tires directly from the Defendants.

The case is entitled In Re: Passenger Vehicle Replacement Tires Antitrust Litigation, No. 5:24-md-03107-SL (N.D. OH).

Court Grants Class Certification in DXC Securities Litigation

On May 2, 2024, Hon. Charles F. Adams of Santa Clara County Superior Court granted Plaintiffs’ motion for class certification in the In re HPE Enterprise Services – DXX Technology Co. Merger Litigation.

Girard Sharp serves as co-lead counsel in this litigation, with attorneys Adam Polk and Sean Greene taking the lead for the firm. The Court’s order follows a contested hearing on March 7, 2024, in which Adam argued for the Plaintiffs.

The certified class includes “all persons who acquired DXC common stock in direct exchange for CSC securities in the April 1, 2017 Merger Exchange.”

Jordan Elias Publishes Antitrust Restoration from California Anchored by a New Monopolization Synthesis

Partner Jordan Elias’s new article, Antitrust Restoration from California Anchored by a New Monopolization Synthesis, came out this week in Competition, the Journal of the Antitrust and Unfair Competition Section of the California Lawyers’ Association.

The article makes recommendations on how California law should be amended to counteract unlawful monopolies, an issue now being explored by the state’s Law Revision Commission. Drawing on his antitrust practice experience, Jordan argues for a return to mid-twentieth-century principles in structuring a new law that can be effectively used in cases against alleged monopolists.

An elected member of the American Law Institute, Jordan is the author of several other law review articles and book chapters.

Scott Grzenczyk to Speak on ABA Panel: Class Certification in Pharmaceutical Antitrust Litigation

Partner Scott Grzenczyk will speak on an ABA panel titled “Class Certification in Pharmaceutical Antitrust Litigation.” The event will be held on Monday, July 31.

Panelists will provide class certification decisions impacting both direct and indirect purchasers (end-payors). In particular, they will discuss the recent In re Niaspan Antitrust Litigation (3d Cir.) decision relating to end-payor ascertainability, and the In re Zetia Antitrust Litigation (4th Cir.) decision relating to direct purchaser numerosity.

Scott is a member of the ABA’s Antitrust Section and often contributes content for ABA publications.

Scott Grzenczyk Presents at ABA Chicago Class Actions and Mass Torts Regional Conference

Partner Scott Grzenczyk will be presenting at this year’s Class Actions and Mass Torts Regional CLE Program in Chicago, presented by the Litigation Section of the American Bar Association. The event takes place June 17, 2022. Scott will be one of two experts on a panel entitled “Litigating Price Premium Claims in Consumer Class Actions.” The panel will focus on the Supreme Court’s decision in Comcast Corp. v. Behrend and subsequent case law that has made clear that a plaintiff in a consumer class action must show how they will prove class-wide injury with common evidence in a manner that is consistent with the theory of liability asserted. To meet this burden, the class action plaintiff bar has employed various techniques, including surveys and conjoint and regression analyses. The panel will discuss the current state of the law, commonly used damages models, and plaintiff and defense side strategies. Scott will be joined by Kelly Nordby of Ankura and moderator David Singh of Weil Gotshal & Manges LLP. See here for details and registration information.

Daniel Girard Presents at NYU Law School Conference on COVID and the Courts

Today, Partner Daniel Girard served as a panelist at a conference hosted by the Center on Civil Justice at NYU Law School entitled “COVID and the Courts.” The event was held as a digital conference. The conference explored how the COVID-19 pandemic has impacted the court system and the procedural changes that have taken place. Dan joined a panel discussing “Post-COVID: What Innovations Should We Keep?” NYU Law professor Troy McKenzie moderated, and panelists included District Judge Lee Rosenthal (S.D.
